Wilbur Leroy Sabin appeals from his judgment of conviction and sentences for one count of lewd conduct with a minor under the age of sixteen and one count of sexual abuse of a minor under the age of sixteen. I.C. §Â§ 18-1508, -1506. The issues raised on appeal are: (1) was Sabins guilty plea to lewd conduct with a minor, voluntary; (2) did the district court err in revoking bail immediately after the two guilty pleas were accepted; (3) did the court err in failing to order a psychological evaluation as part of the presentence investigation; (4) did the court err by refusing to retain jurisdiction over Sabin; and (5) were the sentences excessive? We affirm the judgment of conviction, but vacate the sentences for the reasons stated below.
